Platkin on Today’s Firearms Ruling: ‘Devastating’

State Senate President Steve Sweeney called for the governor’s chief counsel Matt Platkin to resign over the mishandling of sexual assault charges brought by Katie Brennan against Al Alvarez, another state worker, according to a Press of Atlantic City story.

Statement from Attorney General Matthew J. Platkin on Today’s Ruling Regarding Firearms in Sensitive Places

 

TRENTON – Today’s decision is devastating for public safety. Over and over, the evidence has shown that keeping firearms out of sensitive places will keep our residents safe, and our elected officials passed sensible laws to do exactly that. But the court now insists that we are powerless to protect New Jersey residents, and proclaims that the Second Amendment requires allowing guns at parks and beaches, in libraries, at public gatherings, in zoos, and even in bars, among other sensitive places. This decision is bad constitutional law and bad for New Jersey. We will be appealing immediately.

There is one silver lining: Individuals can still control whether and when to allow firearms on their property. No one may carry a firearm inside someone else’s home, or into a business closed to the public, without the owner’s express permission. And for everyone else – for retail establishments and other businesses open to the public – the owners can still make clear that carrying firearms is not welcome on their premises, just as homeowners can make clear guns are unwelcome on their lawns and driveways. Nothing in today’s opinion changes that important reality.

    This is what the Bill of Rights states so stop your whining. My guns have not hurt a single soul in over 16,000 days. NJ is a HORRIBLE place to be a gun owner.

  3. Heartbreaking news. NJ was like a sanctuary in the gun madness. So sad. I fear for the life of my grandchildren and all the people I love with such a prevalence of guns.

    Evil people don’t care about your petty laws, or any law, when it comes to gun free zones!That’s where the greatest number of shootings occur, save for Chicago. Legally carried concealed weapons would deter a lot of the violence. Unless the shooter is on a suicide mission.

  10. Lawyers pass laws to favor lawyers. Criminals pass laws that favor criminals. The politicians are all well protected, and they couldn’t care less about the safety of the vermin that elect them. They just want to step on the throats of all law abiding citizens.

  11. The right to bear arms is a Constitutional right given to us by our founding fathers. As stated in the Constitution it is a right that shall not be infringed upon. The problem is is that too many politicians who have taken that Oath to uphold and defend and abide by the Constitution have forgotten that Oath. In my opinion any politician that breaks that promise should be instantly removed from office and replaced by someone who will abide by it

  12. Our law has to be updated. These laws were made in 1776. This is 2023, and the firearms we have now weren’t even dreamed off 200 years ago. What was good back then can’t apply today

  14. The gun laws in the US are archaic. The basis of gun ownership dates back to the 1700’s. No country in the world has as many guns per capita as the US. The second closest country is Syria for gods sake! A third world backwater country that “only” has 60% as many guns as people! The self serving US is carrying the horn of having something on the order of 130 guns per person! That’s more than one gun for every man woman and child in the country! Within my family there are no known gun owners and that accounts for approximately 25 people, so that means there are an additional 33 guns floating around for the other idiots to tote around. While I have no doubt that some owners are actually rational it seems that most I encounter are off the wall. This is supposed to be a progressive and free country. Others that are have gun counts closer to 25% of the population.

  15. You really have to stop your whining. The Supreme Court has spoken, The 2nd amendment is not a second class bill of rights. There is NO evidence that law abiding gun owners add to national gun violence. There are 60 thousand incidents per year where law abiding gun owners have defended human life. You won’t see the cronies from NJ cite these facts.

The fact that people believe them, when they say they want to keep New Jersey residents safe with these laws it’s just keeping legal gun ownership down to a minimum while the criminals run around with high capacity magazines in their guns. The criminals care nothing about your laws, your law is to protect the criminal to make sure that no one else can have a gun except for a cop around so they can freely do whatever they want and not even think about there being opposition. Anybody with a legal gun is not taking it out unless it is necessary to defend a human life, can they cite one incident in New Jersey where a legal concealed carry gun owner committed a crime with it? No they can’t because there isn’t any

All those members of the “well regulated militia” who legally purchase guns still shoot down innocent people. Leave gun rights to individual states.   18. Somebody, please help me out here because I think I’m going to lose it: A federal judge has — again — overturned an attempt to keep people from harm. For what? Who needs to carry a gun into a library, on a crowded beach, a zoo and, of all places, a bar?!

    How can this judge keep a straight face or even sleep knowing, because of her careless declaration, American citizens will not live safer lives in New Jersey? This craziness grows ever more insidious, based on what amounts to nothing more than a legal technicality. 2A has crept into our daily lives like a virus. And what’s worse, the sickness is by choice.

    How many times do we need to hear it, “The shooter obtained the gun legally”? How many times; when it’s no longer safe to leave home? When we all finally crack from the strain? When our children become numb to the possibility of a happy life? When it’s no longer possible to trust a coworker, a neighbor and maybe a friend too?!

    Strangely, it all seems to be making sense: America is a place that can make you crazy. So screw it; let us all play our part in Paranoid Nation: A gun for everyone, wherever you want, whenever you want, however you want, all the damn time!

    The New Jersey AG absolutely must take a stand. Somebody with authority, somewhere, needs to start playing hardball, now. We need to start ignoring the US Supreme Court rulings on 2A; not arbitrarily but out of necessity — to start saving lives!

    It has been abundantly evident for much too long: No good will come from this Court’s opinion of the 2nd Amendment. Not now, and not ever.

  19. The Democrats hate to see any chance of their protect class, the criminal get hurt. It’s our right to protect ourselves and our families. All the gun laws in the world do not stop a criminal from carrying.
    For all you saying that the 2nd is from a different time and doesn’t apply to todays guns, that’s like saying the 1st amendment only applies to things written on an old printing press.

  20. The reality is that gun laws only favor the criminal. The reason being that criminals don’t follow any laws, and they only make honest citizens targets.

  21. I’ve read time and time again a criminal with an illegal gun is arrested. When he goes to court the charges are downgraded or dropped in a plea deal. We have enough gun laws let’s start using them.

  23. As a conceald carry permit holder you know I have been extensively vetted through several back ground checks you know I have never committed a crime. You know I have demonstrated that I can safely handle a fire arm what exactly do I know about those against it. Many states have had a carry permit for years with no added crime even states with constitutional carry don’t see a sharp rise in crime.
    To some of the comments carrying a fire arm every day dosnt guarantee my saftey nor does it guarantee I will make it out of a use of force situation, what it gives is another tool to be able to defend my family myself or someone else in need. Being alert of your surroundings and keeping yourself out of situations is number one.
    I bet no one expects a fire but we all have fire extinguishers on hand. The ability to defend yourself beats hiding in a closet at the mercy of some one hell bent on doing harm

    As a nj permit to carry a handgun holder you know that I have never been convicted of a crime I have passed multiple background checks, and I am in good mental health. What exactly do I know about you.
    Carrying a handgun does not make you safe nor does it guarantee you will come out of a use of force situation but it is a tool to be used as a last resort to protect your self or family from someone hell bent on causing harm. Knowing your surroundings avoiding violent areas is the first steps to avoiding situations. I bet know one expects a fire but we all have fire extinguishers. It has been ruled police have no duty to protect an individual so you are your first responder. It beats hiding in a closet waiting at the mercy of evil
