The law firm of Stark & Stark announced it has obtained a settlement of $800,000 in a case involving a 49-year-old man who was rear-ended in his car on I-195 in Hamilton, NJ. As a result of the vehicular accident, he suffered injuries to both his back and neck and ultimately had to undergo a lumbar decompression and laminectomy.

The victim, a resident of Delanco, was represented by Shareholder Deborah S. Dunn, Esq., with Stark & Stark, headquartered in Lawrenceville. While the defendant agreed that he was negligent and caused the crash, he attempted to avoid responsibility by alleging that the victim’s injuries were not caused by the crash and characterizing the impact from the crash as minimal.

By recovering $800,000 in compensatory damages for the victim, Ms. Dunn was able to alleviate the financial burden on her client that resulted from the crash and force the defendant to take full responsibility for the injuries he caused.

“By bringing the insurance company to a fair settlement, we not only held the defendant responsible for his negligence, we held the insurance company responsible for their contractual obligation as well,” Ms. Dunn stated. “All too often, the latter is the greater difficulty.”
