Warren K. MacRae Joins the Gibbons Intellectual Property Group

Gibbons P.C. is pleased to announce that Warren K. MacRae has joined the firm’s Intellectual Property Group as a Director in the New York City office.

Mr. MacRae brings to Gibbons great versatility in intellectual property (IP), with a depth of experience ranging from patent strategic counseling and patent due diligence to, most notably, litigation of high-stakes patent cases, particularly in the life sciences and biotech fields. For more than three decades, Mr. MacRae has represented Big Pharma and biotech companies, guiding his clients in structuring, preparing, and negotiating agreements for a broad range of IP and technology-centered transactions, including licenses, technology transfers, complex partnerships, strategic alliances, royalty monetization, and merger and acquisition transactions.

Armed with advanced degrees in chemistry and organic chemistry, Mr. MacRae, over the course of his career, has successfully defended patents covering hundred-million and billion dollar drug products while representing leading pharmaceutical companies in Hatch-Waxman cases related to compounds, compositions, and usage methods. He has litigated against dozens of generic companies and has been the primary attorney responsible for developing strategies to defeat generic challenges to infringement, validity, and enforceability of his clients’ patents. Mr. MacRae has argued numerous appeals before the Board of the United States Patent and Trademark Office (USPTO), argued before the United States Court of Appeals for the Federal Circuit (C.A.F.C.), and litigated inter partes reviews and multiparty interferences before the USPTO Board.

Mr. MacRae joins Gibbons from Loeb & Loeb LLP, where he was a partner in the firm’s Patent Litigation practice for 16 years. Before Loeb & Loeb, he was a partner in the Patent Life Sciences and Litigation practice at Bryan Cave LLP (now Bryan Cave Leighton Paisner LLP). He is admitted to the U.S. Supreme Court, C.A.F.C., and the U.S. District Courts for the Southern, Eastern, and Western Districts of New York, and admitted to practice before the USPTO.
