Scharfenberger & Flynn Joint Statement on SCOTUS 2nd Amendment Decision
“The ruling by the U.S. Supreme Court is monumental in cementing that the Second Amendment rights of law-abiding citizens across the nation as a whole and refusing to treat the constitutional rights afforded by the Second Amendment as different than any other right protected by the Bill of Rights.
Governor Murphy’s continued use of Executive Orders to interfere with the State Legislature’s role to legislate in this matter should not be countenanced by our Democratic colleagues. The Court made clear that such arbitrary attempts by government officials to overregulate in the name of gun control infringe upon the rights of citizens who wish to defend themselves. This is yet another example of the Governor’s unfamiliarity of his role and illegal expansion of his limited executive authority.
We will not permit this State to shun its duty to instead enact laws that focus on combating the dramatic increase in crime in this State with illegal guns, especially in some of our most vulnerable areas, rather than target the rights of law-abiding citizens when it is politically expedient.
We look forward to working with our colleagues in the N.J. Legislature to review existing laws to make those changes necessary to conform with the Supreme Court’s decision – specifically, protect citizens rights to carry outside the home for self-defense.”
